Vehicle Transfer of Ownership
Complete guide to transferring vehicle ownership through Vahan Parivahan. Learn the process, documents, fees, and NOC requirements for buying or selling a used vehicle.
When you buy or sell a used vehicle, the ownership must be legally transferred from the seller to the buyer through the Regional Transport Office (RTO). This process, known as Transfer of Ownership, updates the vehicle registration records in the Vahan database to reflect the new owner. Until the transfer is complete, the vehicle remains registered in the seller's name, which means the seller is legally responsible for any traffic violations, accidents, or criminal activities involving the vehicle.
The transfer of ownership must be completed within 14 days of the sale as per the Motor Vehicles Act. Failure to transfer ownership within this period can result in penalties. The process can be initiated online through the Vahan Parivahan portal, though both the buyer and seller need to be involved in the documentation process.
It is crucial for both parties to ensure the transfer is completed promptly. For the seller, an incomplete transfer means continued liability for the vehicle. For the buyer, an untransferred vehicle means you do not legally own it, which can cause issues with insurance claims, resale, and legal disputes. Always insist on completing the ownership transfer as part of the vehicle sale transaction.
Form 29 & Form 30
Notice of transfer and application for transfer of ownership. Both forms must be signed by the seller and buyer.
Original RC
The existing Registration Certificate must be surrendered at the RTO for reissue in the new owner's name.
Sale Agreement
A written agreement between buyer and seller stating the sale price, date, and terms of the vehicle sale.
NOC from Financier
If the vehicle has an active loan, a No Objection Certificate from the financing bank is required.
Insurance Certificate
Valid motor insurance policy. The insurance needs to be transferred to the new owner's name after RC transfer.
Address Proof (Buyer)
Aadhaar Card, Passport, or Voter ID of the buyer for address verification in the new RC.
PUC Certificate
Valid Pollution Under Control certificate at the time of transfer.
Road Tax Receipt
Proof of road tax payment. If tax is pending, it must be cleared before the transfer.
